Translation for solicitors and court files: commission the evidence set clearly

A legal translation order works best when it follows the evidence schedule, document version and recipient’s directions. Hearing interpretation should be arranged separately.

Begin with the document schedule

Ask the instructing solicitor or other responsible professional to identify the documents required for translation, the destination language and the deadline. Use their schedule to preserve exhibit names, page references and chronological order. A case file may contain a contract, registry record, correspondence and a court decision, each with different terminology and a different role in the bundle.

Preserve the references a reader will use

Keep clause and paragraph numbering, annex titles, case numbers, dates and currency identifiers consistent. Where the translation has a different page layout from the source, agree a practical cross-reference system. Supply the complete document rather than an isolated excerpt when omitted definitions or attachments could change the interpretation of a passage.

Identify terminology and names at the outset

Provide existing English spellings for parties, company names and personal names, together with relevant official records. For Polish, Ukrainian and Russian institutional terms, the translation should identify the source institution precisely. If a particular term has been used elsewhere in the same case, include that material in the assessment so terminology can remain consistent without concealing differences in the source texts.

Agree the required form of certification

The responsible professional should identify the court or other recipient’s directions, including whether a signed translation certificate or a specific statutory authorisation is requested. A Ukrainian–Polish sworn translation in Poland follows the confirmed Polish language registration. A UK certificate or a Cyprus statutory sworn translation is a different requirement; the correct route needs to be established for the actual submission.

A hearing interpreter is arranged through a different process

GOV.UK’s court-interpreter guidance distinguishes criminal defendants, defence witnesses and prosecution witnesses: the court, defence solicitor and prosecuting agency have different roles in arranging an interpreter. Civil and family provision depends on case type and published conditions. Contact the court or tribunal before the hearing rather than assuming that ordering document translations also reserves a hearing interpreter.

For a Scottish or Northern Irish case, obtain the hearing arrangements from the relevant court service. Identify the jurisdiction in the commissioning note so the document and interpreting requests go to the correct recipient.

Control versions before delivery

If a pleading, statement or contract changes during translation, mark the revised version and identify the amended passages. Agree whether the final file requires an editable document, a signed PDF, paper originals or a combination. Deliver the translation against the approved evidence schedule and retain clear version labels so the professional assembling the bundle can select the correct document without reconstructing the correspondence.
